These Terms and Conditions of the Online Store were prepared by the lawyers of Regulaminowo.pl Online Store www.videospace.agency cares about consumer rights. A consumer may not waive the rights granted to him under the Consumer Rights Act. Contract provisions less favorable to the consumer than the provisions of the Consumer Rights Act shall be invalid, and the provisions of the Consumer Rights Act shall apply in their place. The provisions of these Terms and Conditions are not intended to exclude or limit any of the rights of consumers to which they are entitled under mandatory provisions of law, and any possible doubts should be interpreted in favor of the consumer. In the event of a possible inconsistency between the provisions of these Regulations and the aforementioned regulations, these regulations shall prevail and shall be applied.

1. GENERAL PROVISIONS

1.1 The Online Store available at the Internet address www.videospace.agency is operated by VIDEOSPACE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ based in Poznań (registered office and delivery address: Strzelecka 29A/39, 61-846 Poznań); entered in the Register of Entrepreneurs of the National Court Register under the KRS number 0000752496; the register court where the company's records are kept: District Court Poznań - Nowe Miasto and Wilda in Poznań, IX Economic Department of the National Court Register; share capital of: PLN 5,000; NIP: 7861718889; REGON: 381535071, e-mail address:studio@nullvideospace.agencyand contact telephone number: +48 61-250-44-13.

1.2 These Regulations are addressed to both consumers and businesses using the Online Store, unless a particular provision of the Regulations provides otherwise.

1.3 The administrator of the personal data processed in the Online Store in connection with the implementation of the provisions of these Regulations is the Seller. Personal data are processed for the purposes, for the period and based on the grounds and principles indicated in the privacy policy published on the website of the Online Store. The privacy policy primarily contains rules regarding the Administrator's processing of personal data in the Online Store, including the grounds, purposes and duration of personal data processing and the rights of data subjects, as well as information regarding the use of cookies and analytical tools in the Online Store. Use of the Online Store, including making purchases, is voluntary. Likewise, the related provision of personal data by the Customer or Client using the Online Store is voluntary, subject to the exceptions indicated in the privacy policy (conclusion of a contract and statutory obligations of the Seller).

1.4 Definitions:

AKT O USŁUGACH CYFROWYCH, AKT – rozporządzenie Parlamentu Europejskiego i Rady (UE) 2022/2065 z dnia 19 października 2022 r. w sprawie jednolitego rynku usług cyfrowych oraz zmiany dyrektywy 2000/31/WE (akt o usługach cyfrowych) (Dz.U. L 277 z 27.10.2022, s. 1–102).
BLOG – Usługa Elektroniczna, internetowy blog dostępny w Sklepie Internetowym dla jego Usługobiorców umożliwiający im przeglądanie wpisów Usługodawcy, w szczególności dotyczących Jego działalności oraz oferowanych Produktów.
DZIEŃ ROBOCZY – jeden dzień od poniedziałku do piątku z wyłączeniem dni ustawowo wolnych od pracy.
FORMULARZ KONTAKTOWY – Usługa Elektroniczna, interaktywny formularz dostępny w Sklepie Internetowym umożliwiający bezpośredni kontakt z Usługodawcą.
FORMULARZ REJESTRACJI – formularz dostępny w Sklepie Internetowym umożliwiający utworzenie Konta.
FORMULARZ ZAMÓWIENIA – Usługa Elektroniczna, interaktywny formularz dostępny w Sklepie Internetowym umożliwiający złożenie Zamówienia, w szczególności poprzez dodanie Produktów do elektronicznego koszyka oraz określenie warunków Umowy Sprzedaży, w tym sposobu dostawy i płatności.
KLIENT – (1) osoba fizyczna posiadająca pełną zdolność do czynności prawnych, a w wypadkach przewidzianych przez przepisy powszechnie obowiązujące także osoba fizyczna posiadająca ograniczoną zdolność do czynności prawnych; (2) osoba prawna; albo (3) jednostka organizacyjna nieposiadająca osobowości prawnej, której ustawa przyznaje zdolność prawną – która zawarła lub zamierza zawrzeć Umowę Sprzedaży ze Sprzedawcą.
KODEKS CYWILNY – ustawa Kodeks cywilny z dnia 23 kwietnia 1964 r. (Dz.U. 1964 nr 16, poz. 93 ze zm.).
KONTO – Usługa Elektroniczna, oznaczony indywidualną nazwą (loginem) i hasłem podanym przez Usługobiorcę zbiór zasobów w systemie teleinformatycznym Usługodawcy, w którym gromadzone są dane podane przez Usługobiorcę oraz informacje o złożonych przez niego Zamówieniach w Sklepie Internetowym.
NEWSLETTER – Usługa Elektroniczna, elektroniczna usługa dystrybucyjna świadczona przez Usługodawcę za pośrednictwem poczty elektronicznej e-mail, która umożliwia wszystkim korzystającym z niej Usługobiorcom automatyczne otrzymywanie od Usługodawcy cyklicznych treści kolejnych edycji newslettera zawierającego informacje o Produktach, nowościach i promocjach w Sklepie Internetowym.
NIELEGALNE TREŚCI – informacje, które same w sobie lub przez odniesienie do działania, w tym sprzedaży Produktów lub świadczenia Usług Elektronicznych, nie są zgodne z prawem Unii Europejskiej lub z prawem jakiegokolwiek państwa członkowskiego, które jest zgodne z prawem Unii Europejskiej, niezależnie od konkretnego przedmiotu lub charakteru tego prawa.
PRODUKT – dostępna w Sklepie Internetowym (1) treść cyfrowa, (2) usługa (w tym usługa cyfrowa i inna niż cyfrowa) lub (3) prawo będące przedmiotem Umowy Sprzedaży między Klientem a Sprzedawcą.
REGULAMIN – niniejszy regulamin Sklepu Internetowego.
SKLEP INTERNETOWY – sklep internetowy Usługodawcy dostępny pod adresem internetowym: www.videospace.agency.
SPRZEDAWCA, USŁUGODAWCA – VIDEOSPACE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ z siedzibą w Poznaniu (adres siedziby i adres do doręczeń: ul. Strzelecka 29A/39, 61-846 Poznań); wpisana do Rejestru Przedsiębiorców Krajowego Rejestru Sądowego pod numerem KRS 0000752496; sąd rejestrowy, w którym przechowywana jest dokumentacja spółki: Sąd Rejonowy Poznań – Nowe Miasto i Wilda w Poznaniu, IX Wydział Gospodarczy Krajowego Rejestru Sądowego; kapitał zakładowy w wysokości: 5 000 zł; NIP: 7861718889; REGON: 381535071, adres poczty elektronicznej: studio@nullvideospace.agency oraz numer telefonu kontaktowego: +48 61-250-44-13.
UMOWA SPRZEDAŻY – (1) umowa o dostarczanie Produktu (w przypadku treści cyfrowej lub usługi cyfrowej), (2) umowa o świadczenie lub korzystanie z Produktu (w przypadku usługi innej niż cyfrowa oraz pozostałych Produktów) zawierana albo zawarta między Klientem a Sprzedawcą za pośrednictwem Sklepu Internetowego.
USŁUGA ELEKTRONICZNA – usługa świadczona drogą elektroniczną przez Usługodawcę na rzecz Usługobiorcy za pośrednictwem Sklepu Internetowego i niebędąca Produktem.
USŁUGA SZKOLENIOWA – Produkt, usługa polegająca na organizacji przez Sprzedawcę na rzecz Klienta szkolenia będącego przedmiotem zawartej Umowy Sprzedaży.
USŁUGOBIORCA – (1) osoba fizyczna posiadająca pełną zdolność do czynności prawnych, a w wypadkach przewidzianych przez przepisy powszechnie obowiązujące także osoba fizyczna posiadająca ograniczoną zdolność do czynności prawnych; (2) osoba prawna; albo (3) jednostka organizacyjna nieposiadająca osobowości prawnej, której ustawa przyznaje zdolność prawną – korzystająca lub zamierzająca korzystać z Usługi Elektronicznej.
USTAWA O PRAWACH KONSUMENTA – ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Dz.U. 2014 poz. 827 ze zm.).
ZAMÓWIENIE – oświadczenie woli Klienta składane za pomocą Formularza Zamówienia i zmierzające bezpośrednio do zawarcia Umowy Sprzedaży Produktu ze Sprzedawcą.
2.    USŁUGI ELEKTRONICZNE W SKLEPIE INTERNETOWYM

2.1 The following Electronic Services are available in the Online Store: Blog, Contact Form, Order Form and Account and Newsletter.

Przeglądanie Bloga możliwe jest po przejściu do zakładki „Newsy” widocznej w Sklepie Internetowym. Blog jest dostępny nieodpłatnie dla wszystkich odwiedzających Sklep Internetowy bez potrzeby podawania jakichkolwiek danych czy dokonywania innych czynności. W ramach Bloga Usługodawca publikuje artykuły nawiązujące do tematyki Sklepu Internetowego oraz Produktów.
Usługobiorca ma możliwość w każdej chwili i bez podania przyczyny zaprzestania korzystania z Usługi Elektronicznej Bloga poprzez zamknięcie przeglądarki internetowej.
Formularz Kontaktowy – korzystanie z Formularza Kontaktowego rozpoczyna się po wykonaniu przez Usługobiorcę łącznie dwóch kolejnych kroków – (1) przejścia do zakładki „Kontakt” i (2) kliknięciu na stronie Sklepu Internetowego po wypełnieniu Formularza Kontaktowego pole „Wyślij”. W FormularzuKontaktowym niezbędne jest podanie przez Usługobiorcę następujących danych: imię i nazwisko, adres poczty elektronicznej oraz numer telefonu kontaktowego. W celu sprawniejszej obsługi, Usługobiorca może również podać treść zapytania.
Usługa Elektroniczna Formularz Kontaktowy świadczona jest nieodpłatnie oraz ma charakter jednorazowy i ulega zakończeniu z chwilą wysłania wiadomości za jego pośrednictwem albo z chwilą wcześniejszego zaprzestania korzystania z niego przez Usługobiorcę.
Formularz Zamówienia – korzystanie z Formularza Zamówienia rozpoczyna się z momentem dodania przez Klienta pierwszego Produktu do elektronicznego koszyka w Sklepie Internetowym. Złożenie Zamówienia następuje po wykonaniu przez Klienta łącznie dwóch kolejnych kroków – (1) po wypełnieniu Formularza Zamówienia i (2) kliknięciu na stronie Sklepu Internetowego po wypełnieniu Formularza Zamówienia pola „Kupuję i płacę” – do tego momentu istnieje możliwość samodzielnej modyfikacji wprowadzanych danych (w tym celu należy kierować się wyświetlanymi komunikatami oraz informacjami dostępnymi na stronie Sklepu Internetowego). W Formularzu Zamówienia niezbędne jest podanie przez Klienta następujących danych dotyczących Klienta: imię i nazwisko/nazwa firmy, adres (ulica, numer domu/mieszkania, kod pocztowy, miejscowość, kraj), adres poczty elektronicznej, numer telefonu kontaktowego oraz danych dotyczących Umowy Sprzedaży: Produkt/y, ilość Produktu/ów, miejsce i sposób dostawy Produktu/ów, sposób płatności. W wypadku Klientów niebędących konsumentami niezbędne jest także podanie nazwy firmy oraz numeru NIP.
Usługa Elektroniczna Formularz Zamówienia świadczona jest nieodpłatnie oraz ma charakter jednorazowy i ulega zakończeniu z chwilą złożenia Zamówienia za jego pośrednictwem albo z chwilą wcześniejszego zaprzestania składania Zamówienia za jego pośrednictwem przez Usługobiorcę.
Konto – korzystanie z Konta możliwe jest po wykonaniu łącznie dwóch trzech kolejnych kroków przez Usługobiorcę – (1) wypełnieniu Formularza Rejestracji, (2) kliknięciu pola „ZAREJSTRUJ SIĘ” oraz (3) kliknięciu linka aktywacyjnego, który automatycznie zostaje doręczony Usługobiorcy na wskazany przez niego adres poczty elektronicznej. W Formularzu Rejestracji niezbędne jest podanie przez Usługobiorcę następujących danych Usługobiorcy adres poczty elektronicznej.
Usługa Elektroniczna Konto świadczona jest nieodpłatnie przez czas nieoznaczony. Usługobiorca ma możliwość, w każdej chwili i bez podania przyczyny, usunięcia Konta (rezygnacji z Konta) poprzez wysłanie stosownego żądania do Usługodawcy, w szczególności za pośrednictwem poczty elektronicznej na adres: studio@nullvideospace.agency lub też pisemnie na adres: ul. Sportowa 3A/26, 63-000 Środa Wielkopolska.
Newsletter – korzystanie z Newslettera następuje po podaniu w pop-upie pojawiającym się na stronie Sklepu Internetowego adresu poczty elektronicznej, na który mają być przesyłane kolejne edycje Newslettera i kliknięciu pola „Zapisz się!”.
Usługa Elektroniczna Newsletter świadczona jest nieodpłatnie przez czas nieoznaczony. Usługobiorca ma możliwość, w każdej chwili i bez podania przyczyny, wypisania się z Newslettera (rezygnacji z Newslettera) poprzez wysłanie stosownego żądania do Usługodawcy, w szczególności za pośrednictwem poczty elektronicznej na adres: studio@nullvideospace.agency lub też pisemnie na adres: Sportowa 3A/26, 63-000 Środa Wielkopolska.
2.2.       Wymagania techniczne niezbędne do współpracy z systemem teleinformatycznym, którym posługuje się Usługodawca: (1) komputer, laptop lub inne urządzenie multimedialne z dostępem do Internetu; (2) dostęp do poczty elektronicznej; (3) przeglądarka internetowa w aktualnej wersji: Mozilla Firefox; Internet Explorer; Opera; Google Chrome; Safari lub Microsoft Edge; (4) zalecana minimalna rozdzielczość ekranu: 1024×768; (5) włączenie w przeglądarce internetowej możliwości zapisu plików Cookies oraz obsługi Javascript.

2.3 The Client is obliged to use the Online Shop in a manner consistent with the law and morality, taking into account respect for personal rights and copyrights and intellectual property rights of the Service Provider and third parties. The Client is obliged to enter data in accordance with the facts. The Client is prohibited from providing unlawful content, including Illegal Content.

2.4 The procedure for complaints regarding Electronic Services is indicated in Section. 7. of the Regulations.

3. CONDITIONS FOR CONCLUDING A SALES CONTRACT

3.1. The conclusion of the Sales Agreement between the Customer and the Seller shall take place after the Customer places an Order by means of the Order Form on the Online Store in accordance with point. 2.1.3 of the Terms and Conditions.

3.2 The price of the Product or remuneration for the Product shown on the website of the Online Store is given in euros and includes taxes. The Customer is informed about the total price or remuneration including taxes , and when the nature of the Product does not allow, judging reasonably, to calculate their amount in advance - the manner in which they will be calculated, as well as about the costs of delivery (including fees for transportation, delivery or postal services) and other costs, and when it is not possible to determine the amount of these fees - about the obligation to pay them, on the pages of the Online Store, including when placing an Order and at the moment of expressing by the Customer the will to be bound by the Sales Agreement. In the case of a Sales Contract for a Product concluded for an indefinite period of time or including a subscription, the Seller shall state in the same manner the total price or remuneration including all payments for the billing period, and when the Sales Contract provides for a fixed rate - also the total monthly payments.

3.3 The procedure for concluding a Sales Contract in the Online Store using the Order Form

The conclusion of a Sales Agreement between the Customer and the Seller takes place after the Customer places an Order on the Online Store in accordance with point 2.1.3. of the Terms and Conditions. 2.1.3. of the Terms and Conditions.
After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is made by the Seller sending the Client a relevant e-mail message to the Client's e-mail address provided during the placement of the Order, which contains at least the Seller's statements about receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. Upon receipt by the Customer of the above e-mail message, the Sales Agreement between the Customer and the Seller is concluded.
3.4. The content of the concluded Sales Agreement is recorded, secured and made available to the Customer by (1) making these Terms and Conditions available on the website of the Online Store and (2) sending the Customer the e-mail message referred to in item 3.3.2. of the Terms and Conditions. 3.3.2. of the Terms and Conditions. The content of the Sales Agreement is additionally recorded and secured in the IT system of the Seller's Online Store.

4. METHODS AND TERMS OF PAYMENT FOR THE PRODUCT

4.1 The Seller shall make available to the Customer the following methods of payment for the Sales Agreement:

Payment by bank transfer to the Seller's bank account.
Electronic payments and payment card payments via Stripe and PayPal.com - the possible current payment methods are specified on the website of the Online Store in the information tab concerning payment methods and on the website http://www.stripe.com.pl and https://www.paypal.com/pl.
Settlement of electronic payment and payment card transactions is carried out according to the Customer's choice via Stripe or PayPal.com. Processing of electronic payments and payment cards is carried out by:
com - a company Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland).
PayPal - Company PayPal (Europe) S.a r.l. et Cie, S.C.A., Floor 22-24 Boulavard Royal, L-2449 Luxembourg, Grand Duchy of Luxembourg, Commercial Registry Number: R.C.S. Luxembourg B 118 349, VAT Number: LU22046007.
4.2 Payment Term:

If the Customer chooses to pay by bank transfer, electronic payment or payment card, the Customer is obliged to make the payment within 14 calendar days of the conclusion of the Sales Agreement.
5. COST, METHODS AND DATE OF DELIVERY OF THE PRODUCT

5.1 The delivery of the Product is available in the territory of the Republic of Poland.

5.2 The delivery of the Product to the Customer is chargeable, unless the Sales Agreement provides otherwise. The Product delivery costs (including transportation, delivery and postal service fees) are indicated to the Customer on the pages of the Online Store in the information tab concerning delivery costs and during the placement of the Order, including at the moment of expressing the Customer's will to be bound by the Sales Agreement.

5.3 The Seller shall make available to the Customer the following methods of delivery of the Product:

Electronic delivery in the case of a Product - digital content, which consists in sending to the Customer via e-mail to the e-mail address indicated by the Customer during the placement of the Order a unique Internet link (URL) enabling the download of the Product. In the case of providing a unique web link (URL) that allows downloading the Product, the Seller ensures its correctness for a period of 30 days from the date of providing it, after this period it is necessary to contact the Seller in order to make it available again. During this period, the Seller recommends downloading the Product and saving it digitally in the computer's memory.
5.4. The term of delivery of the Product to the Customer is up to 14 Business Days, unless a shorter term is specified in the description of the Product in question or in the course of placing the Order. In the case of Products with different delivery terms, the delivery term is the longest term specified, which, however, cannot exceed 14 Business Days. The beginning of the term of delivery of the Product to the Customer is calculated as follows:

If the Customer chooses to pay by bank transfer, electronic payment or payment card - from the date of crediting the Seller's bank account or checking account.
6. CONDITIONS FOR PROVIDING TRAINING SERVICES

6.1 This Section 6 of the Terms and Conditions applies to a Product that is a Training Service. Provision of Training Services shall be made in accordance with the provisions of this Section 6. of the Regulations and in accordance with the training program indicated to the Customer on the pages of the Online Store prior to placing an Order.

6.2 The Vendor shall exercise due diligence to ensure that the Training Services are performed correctly, fairly and in accordance with applicable standards.

6.3 The vendor in the organization of training may use assistants and subcontractors, the choice of which he will decide.

6.4 Additional arrangements between the Customer and the Seller preceding the commencement of the Seller's performance may also be necessary for the proper performance of the Training Services. In such a case, the Services shall be provided on the terms and conditions agreed upon in detail by the Customer and the Seller, in particular at the time and place already agreed upon by the parties after the conclusion of the Sales Agreement.

6.5 The subject of Training Services is, as a standard, the organization of a training course on a topic selected by the Client. Depending on the arrangements made and the type of training, training can be organized stationary, as well as online (by means of electronic communication).

6.6 Unless otherwise stipulated in the Sales Agreement, the price of the Training Services paid by the Client includes only the cost of organizing the training (including the cost of training materials and the Client's certificate of participation), excluding the cost of the Client's transportation and accommodation. In the case of online training, the Customer shall also be obliged to bear on its own the cost of data transmission required for participation in the training.

6.7 In the event of a subsequent cancellation, the Customer shall be obliged to reimburse the Vendor for the expenses already incurred for the organization of the training, and to pay remuneration corresponding to the activities performed by the Vendor to date. If the cancellation occurs without a valid reason justifying the need to cancel the training, the Customer shall also compensate the Seller for the damage incurred on general principles.

6.8 If prior to the organization of the training course there is a cancellation by the Seller for reasons for which the Customer is not responsible, or the Sales Agreement is terminated or expires for reasons beyond the control of either party (in particular, force majeure events), the Customer is entitled to a full refund of the costs paid.

6.9 In case of failure to carry out the training on the agreed date for reasons attributable to the Vendor (e.g. caused by accidents, etc.), the Vendor undertakes to provide the organization of the training on another date agreed with the Client. The Service Provider undertakes to inform the Client of the anticipated changes immediately by sending an e-mail message to the Client's address provided in the Order or by sending an SMS message to the telephone number provided. If the proposal of the Vendor is not accepted, the Client is entitled to receive a refund of the payment for the unrealized training.

6.10. The provisions of this Section 6 of the Terms and Conditions do not exclude or limit the mandatory statutory rights of a Customer who is a consumer (and, as of January 1, 2021 and to Contracts concluded as of that date - also of a Customer who is a natural person entering into a contract directly related to his/her business activity, when the content of the contract shows that it does not have a professional character for that person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity).

7. PROCEDURE FOR HANDLING COMPLAINTS

7.1 This Section 7 of the Terms and Conditions sets out the procedure for handling complaints common to all complaints submitted to the Seller, in particular complaints regarding Products, Sales Agreements, Electronic Services and other complaints related to the operation of the Seller or the Online Store.

7.2 A complaint may be filed, for example:

in electronic form via e-mail to:studio@nullvideospace.agency
7.3 It is recommended to provide in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of the irregularity or non-conformity with the contract; (2) the demand for a method of bringing the product into conformity with the contract or a statement of price reduction or withdrawal from the contract or other claim; and (3) contact details of the complainant - this will facilitate and expedite the processing of the complaint. The requirements specified in the preceding sentence are in the form of a recommendation only and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.

7.4 If the contact information provided by the complainant changes during the processing of the complaint, he is obliged to notify the Seller.

7.5 The complainant may attach evidence (e.g. photos, documents or Product) related to the subject of the complaint. The Seller may also ask the complainant to provide additional information or send evidence (e.g. photos), if this will facilitate and expedite consideration of the complaint by the Seller.

7.6 The Seller shall respond to the complaint immediately, but no later than within 14 calendar days of receipt.

7.7 The basis and scope of the Seller's statutory liability are set forth in generally applicable laws, in particular the Civil Code, the Consumer Rights Act and the Act on Providing Electronic Services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended). Additional information regarding the Seller's liability, as provided by law, for the Product's compliance with the Sales Agreement is indicated below:

In the case of a complaint about a Product - digital content or service or a movable thing that serves only as a carrier of digital content - purchased by the Customer on the basis of a Sales Agreement concluded with the Seller from January 1, 2023 or before that date, if the delivery of such a Product was to take place or took place after that date is determined by the provisions of the Consumer Rights Act in the wording in force from January 1, 2023, in particular Articles 43h - 43q of the Consumer Rights Act. These provisions determine, in particular, the basis and scope of the Seller's liability to the consumer, in the event of non-compliance of the Product with the Sales Agreement.
7.8. In addition to the statutory liability, a warranty may be granted for the Product - this is a contractual (additional) liability and can be exercised when the Product is covered by the warranty. The warranty may be provided by an entity other than the Seller (e.g. by the manufacturer or distributor). Detailed terms and conditions of liability under the warranty, including details of the entity responsible for the implementation of the warranty and the entity entitled to benefit from it, are available in the description of the warranty, e.g. in the warranty card or in another place concerning the granting of the warranty. The Seller indicates that in case of non-compliance of the Product with the contract, the Customer is entitled by law to legal remedies on the part and at the expense of the Seller, and that the warranty does not affect these legal remedies.

7.9 The provisions of section 7.7.1 of the Terms and Conditions concerning the consumer shall also apply to the Customer who is a natural person concluding an agreement directly related to his/her business activity, when it is clear from the content of this agreement that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

8. OUT-OF-COURT PROCEDURES FOR HANDLING COMPLAINTS AND INVESTIGATING CLAIMS, AND RULES OF ACCESS TO THESE PROCEDURES

8.1 Out-of-court dispute resolution methods include (1) allowing the parties' positions to be brought closer together, e.g., through mediation; (2) proposing a solution to the dispute, e.g., through conciliation; and (3) resolving the dispute and imposing a solution on the parties, e.g., through arbitration (conciliation court). Detailed information on the possibility for a customer who is a consumer to use out-of-court procedures for handling complaints and pursuing claims, the rules of access to these procedures, and a friendly search engine for entities engaged in amicable dispute resolution are available on the website of the Office of Competition and Consumer Protection at: https://polubowne.uokik.gov.pl/.

8.2 There is a contact point at the President of the Office of Competition and Consumer Protection, whose task is, among other things, to provide consumers with information on out-of-court settlement of consumer disputes. The point can be contacted by consumers: (1) by telephone - by calling 22 55 60 332 or 22 55 60 333; (2) by e-mail - by sending a message to:kontakt.adr@nulluokik.gov.plor (3) in writing or in person - at the Office's Headquarters at Plac Powstańców Warszawy 1 in Warsaw (00-030).

8.3 The consumer shall have the following examples of out-of-court means of handling complaints and claims: (1) a request for dispute resolution to a permanent amicable consumer court; (2) a request for out-of-court dispute resolution to a provincial inspector of the Inspectorate; or (3) the assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., Federation of Consumers, Association of Polish Consumers). Advice is provided, among other things, by e-mail atporady@nulldlakonsumentow.pland at the consumer hotline number 801 440 220 (hotline open on Business Days, from 8:00 a.m. to 6:00 p.m., call charge at the operator's tariff).

9. RIGHT OF WITHDRAWAL

9.1 The right of withdrawal from a contract concluded at a distance does not apply to the consumer with respect to contracts:

(1) for the provision of services for which the consumer is obliged to pay the price, if the Seller has fully performed the service with the express and prior consent of the consumer, who was informed before the performance began, that after the Seller's performance, he will lose the right to withdraw from the contract, and accepted it; (2) for the provision of digital content not delivered on a tangible medium, for which the consumer is obliged to pay the price, if the Seller has begun performance with the express and prior consent of the consumer, who was informed before the beginning of performance that after the Seller's performance he will lose the right to withdraw from the contract, and has accepted this, and the Seller has provided the consumer with the confirmation referred to in Art. 15 (1) and (2) or Article 21 (1) of the Consumer Rights Act;.
9.2 Subject to sec. 9.1 of the Terms and Conditions, a consumer who has concluded a remote agreement may, within 14 calendar days, withdraw from the agreement without stating a reason and without incurring costs, except for the costs specified in sec. 9.8 of the Regulations. To meet the deadline it is sufficient to send the statement before its expiration. The declaration of withdrawal from the contract may be made, for example:

9.3. A sample withdrawal form is included in Appendix No. 2 to the Consumer Rights Act and is additionally available in pt. 16 of the Regulations. The consumer may use the sample form, but it is not mandatory.

9.4 The period for withdrawal from the contract shall begin:

for a contract in the performance of which the Seller delivers the Product, being obliged to transfer its ownership - from taking possession of the Product by the consumer or a third party indicated by him/her other than the carrier, and in the case of a contract that: (1) includes multiple Products that are delivered separately, in batches or in parts - from taking possession of the last Product, batch or part, or (2) involves the regular delivery of Products for a fixed period - from taking possession of the first Product;
for other contracts - from the date of conclusion of the contract.
9.5. In the case of withdrawal from a contract concluded at a distance, the contract is considered not concluded.

9.6 The seller is obliged to immediately, no later than within 14 calendar days from the date of receipt of the consumer's statement of withdrawal from the contract, return to the consumer all payments made by him. The seller shall refund the payment using the same method of payment used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not involve any costs for him.

9.7 Products - digital content or digital services:

In the case of withdrawal from the contract for the provision of a Product - digital content or digital service - the Seller, from the date of receipt of the consumer's statement of withdrawal, may not use content other than personal data provided or created by the consumer during the use of the Product - digital content or digital service - provided by the Seller, except for content that: (1) are useful only in connection with the digital content or digital service that was the subject of the contract; (2) relate exclusively to the consumer's activity during the use of the digital content or digital service provided by the Seller; (3) have been combined by the trader with other data and cannot be separated from them or can be separated only with the expenditure of disproportionate efforts; (4) have been produced by the consumer jointly with other consumers who can still use them. Except for the cases referred to in (1)-(3,) above, the Seller shall, at the request of the consumer, make available to the consumer content other than personal data that was provided or created by the consumer in the course of using the digital content or digital service provided by the Seller. In the event of withdrawal from the contract, the Seller may prevent the consumer from further use of the digital content or digital service, in particular by preventing the consumer from accessing the digital content or digital service or blocking the user account, which shall not affect the consumer's rights referred to in the preceding sentence. The consumer shall have the right to recover the digital content from the Seller free of charge, without hindrance from the Seller, within a reasonable period of time and in a commonly used machine-readable format.
In the event of withdrawal from the contract for the provision of the Product - digital content or digital service, the consumer shall be obliged to stop using such digital content or digital service and making it available to third parties.
9.8 Possible costs associated with the withdrawal of the consumer from the contract, which the consumer is obliged to pay:

In the case of Products - movable items (including movable items with digital elements) - if the consumer has chosen a method of delivery of the Product other than the cheapest ordinary method of delivery available on the Online Store, the Seller is not obliged to reimburse the consumer for any additional costs incurred by the consumer.
In the case of Products - movable items (including movable items with digital elements) - the consumer shall bear the direct costs of returning the Product.
In the case of Products - services, the performance of which - at the express request of the consumer - began before the expiration of the withdrawal period, the consumer who exercises the right to withdraw from the contract after making such a request, is obliged to pay for the services performed until the withdrawal. The amount of payment shall be calculated in proportion to the extent of the performance performed, taking into account the price or remuneration agreed in the contract. If the price or remuneration is excessive, the basis for calculating this amount shall be the market value of the fulfilled service.
9.9. The provisions contained in this Section 9. of the Terms and Conditions regarding the consumer shall also apply for contracts concluded from January 1, 2021 to the Service Recipient or the Client who is a natural person concluding a contract directly related to his/her business activity, when it follows from the content of this contract that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

10. PROVISIONS FOR ENTREPRENEURS

10.1 This Section 10 of the Terms and Conditions and all provisions contained therein are directed to and thereby bind only the Customer or Service Recipient who is not a consumer. In addition, as of January 1, 2021 and for contracts entered into from that date, this section of the Terms and Conditions and all provisions contained therein are not directed to and thus do not bind a Customer or Service Recipient who is a natural person entering into a contract directly related to his/her business activity, when it follows from the content of that contract that it does not have a professional character for that person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity, unless the application to such persons of the provisions contained in this section of the Terms and Conditions is not prohibited.

10.2 The Seller shall have the right to withdraw from the Sales Agreement within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may take place without giving any reason and does not give rise to any claims on the part of the Customer against the Seller.

10.3 The Seller's liability under the warranty for the Product or the Product's non-conformity with the Sales Agreement is excluded.

10.4 The Seller shall respond to the complaint within 30 calendar days of receipt.

10.5. the Seller has the right to limit the available payment methods, including requiring prepayment in full or in part, and this regardless of the payment method chosen by the Customer and the fact of concluding the Sales Agreement.

10.6 The Service Provider may terminate the contract for the provision of Electronic Services with immediate effect and without indicating reasons by sending the Customer a relevant statement.

10.7 The liability of the Service Provider/Seller to the Client/Customer, regardless of its legal basis, shall be limited - both as part of a single claim, as well as for all claims in the aggregate - to the amount of the price paid and delivery costs under the Sales Agreement, but no more than one thousand zlotys. The limitation of the amount referred to in the preceding sentence shall apply to all claims made by the Customer/Client against the Service Provider/Seller, including in the absence of a Sales Agreement or unrelated to a Sales Agreement. The Service Provider/Seller shall be liable to the Service Recipient/Customer only for typical damages foreseeable at the time of conclusion of the contract and shall not be liable for lost profits. The Seller shall also not be liable for any delay in transportation of the shipment.

10.8 In the event of cancellation of the Training Services less than 14 Business Days before the agreed date of organization of the training, the Customer may be charged by the Vendor with the full costs of participation in the training.

10.9 The Vendor reserves the right to change the facility where the training will be held, as well as to change the person conducting the training, which will not give rise to any claims on the part of the Customer against the Vendor.

10.10. The vendor reserves the right to cancel the training course or postpone the date of organization of the training course in the event that a sufficient number of participants is not reached. The Vendor has the right to cancel the scheduled date of the training also in case of fortuitous situations that could not be foreseen in advance, such as weather factors, sudden indisposition of the trainer, sudden unavailability of the training venue. The cancellation or rescheduling of a training course for the reasons referred to in the following section of the Terms and Conditions will not give rise to any claims on the part of the Client against the Vendor.

10.11. Any disputes arising between the Seller/Service Provider and the Customer/Service Recipient shall be submitted to the court having jurisdiction over the seat of the Seller/Service Provider.

11. PRODUCT USAGE RULES - DIGITAL CONTENT AND SERVICES

11.1 This clause 11 of the Terms and Conditions defines the default rules for the use of Products - digital content and services available on the Online Store. These rules apply in the absence of establishing individual terms of use for a given Product or to the extent not covered by individual terms (e.g. in the case of a license granted by the manufacturer of a given Product, the manufacturer's license will apply).

11.2 The rights to the Product, including copyrights in the case of Products constituting a work within the meaning of the Copyright Law, shall be vested in the Seller or other authorized third parties.

11.3 The Customer, on the basis of the concluded Sales Agreement, shall be entitled to use the Product in the manner and to the extent necessary to use it for the purposes specified in the Sales Agreement, and in the absence of their specification for the purposes for which a Product of this type is usually used, taking into account applicable laws, technical standards or good practices.

11.4 The Customer's use of the Product is possible only for the Customer's own use, including within the scope of the Customer's business activity, unless the Sales Agreement provides otherwise. Subject to the exceptions provided for by generally applicable laws and other provisions of the Sales Agreement: (1) the Customer shall not be entitled to make the Product available to third parties; (2) the Customer shall not be entitled to use the Product for commercial purposes, including marketing the Product; (3) the Customer shall not be entitled to transfer, sublicense or authorize others to use the Product; (4) The Customer shall not be entitled to copy, reproduce, modify, adapt, translate, decode, decompile, disassemble or any other attempt to interfere with the Product, except as necessary to ensure the proper use of the Product in accordance with the Sales Agreement.

11.5 The Customer's use of the Product is possible for the time specified in the Sales Agreement.

11.6 Access to the Product is granted by sending the digital content or a link (URL) for its reproduction to the e-mail address provided by the Customer during the Ordering process.

11.7 The Seller may make a change to a Product that is not necessary for its compliance with the Sales Agreement in the event of at least one of the legitimate reasons, i.e. the change is necessary to adapt the digital content or digital service to a new technical environment or to an increase in the number of users or for other important operational reasons - and only to the extent that this reason affects the change. However, the Seller may not make a change to a Product delivered on a one-time basis. The introduction of the change referred to above may not involve any costs on the part of the consumer, and the Seller is obliged to inform the consumer in a clear and understandable manner about the change being made. If the change referred to above materially and adversely affects the consumer's access to or use of the Product, the Seller is obliged to inform the consumer well in advance on a durable medium about the characteristics and timing of the change and the right to terminate the Sales Agreement without notice within 30 days from the date of the change or the notification of the change, if the notification was later than the change. The right of termination referred to in the preceding task does not apply if the Seller has provided the consumer with the right to keep, at no additional cost, the Product in accordance with the Sales Agreement in an unchanged condition.

12. PRODUCT REVIEWS

12.1 The Seller shall allow its Customers to issue and access reviews of Products and the Online Store under the terms of this section of the Terms and Conditions.

12.2 Customer's opinion is possible by sending an opinion to the e-mail address of the Seller:studio@nullvideospace.agency.

12.3 An opinion about a Product may be issued only for the actually purchased Products in the Seller's Online Store and by the Customer who purchased the Product under review. It is forbidden to conclude fictitious or sham Sales Agreements for the purpose of issuing an opinion about the Product. An opinion about the Online Store may be issued by a person who is a Customer of the Online Store.

12.4 Adding opinions by Clients may not be used for illegal activities, in particular, for activities constituting an act of unfair competition, or activities violating personal rights, intellectual property rights or other rights of the Seller or third parties. The Client, when adding an opinion, is obliged to act in accordance with the law, these Regulations and good morals.

12.5 Opinions are made available directly on the page of the Online Store (e.g., next to a particular Product).

12.6 The Seller shall ensure that published reviews of Products come from its Customers who have purchased the Product. To this end, the Seller shall take the following steps to verify that the reviews come from its Customers:

Publication of an opinion sent to the Seller is preceded by verification. Verification consists in checking the compliance of the opinion with the Terms and Conditions, in particular checking whether the person giving the opinion is a Customer of the Online Store - in this case the Seller checks whether the person has made a purchase at the Online Store, and in the case of an opinion on a Product, additionally checks whether he or she has purchased the Product under review. Verification takes place without undue delay.
In case of doubts of the Seller or objections directed to the Seller by other Customers or third parties, whether a given opinion comes from the Customer or whether a given Customer bought a given Product, the Seller reserves the right to contact the author of the opinion in order to clarify and confirm that he or she is actually a Customer of the Online Store or has purchased the reviewed Product.
12.7 Any comments, appeals against the verification of an opinion, or objections as to whether a given opinion comes from a Customer or whether a given Customer bought a given Product may be submitted in a manner analogous to the complaint procedure indicated in Section 6 of the Terms and Conditions.

12.8 The Seller shall not post or have another person post false opinions or recommendations of Customers and shall not distort opinions or recommendations of Customers for the purpose of promoting its Products. The Seller provides both positive and negative opinions. The Seller does not provide sponsored opinions.

13. PROVISIONS RELATED TO ARTIFICIAL INTELLIGENCE

13.1 General Principles for the Use of Artificial Intelligence (AI) in the Provision of Services

The Seller informs that in order to optimize and innovate its services, it uses advanced artificial intelligence (AI) systems within the meaning of Regulation (EU) 2024/1689 of the European Parliament and of the Council of June 13, 2024. on the establishment of harmonized rules on artificial intelligence and amending Regulations (EC) No. 300/2008, (EU) No. 167/2013, (EU) No. 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144, and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (AI Act) of June 13, 2024 (Official Journal of the EU.L of 2024 p. 1689) (AI Act). The use of AI includes, but is not limited to, the generation of video content, dubbing, personalization of materials, and automation of creative processes.
The Seller is fully responsible for the actions and decisions of its AI systems to the same extent as for the actions of its own employees or subcontractors, in accordance with the general rules of civil liability under the Civil Code. AI is a tool used by the Vendor to fulfill its contractual obligations and not a separate legal entity.
13.2 Customer Rights in Interactions with AI:

The Customer has the right to obtain human intervention when interacting with the AI system, especially if it leads to significant decisions or has a significant impact on the Consumer, in accordance with Article 22 of the RODO.
The Customer has the right to challenge a decision made by the AI system.
The Customer has the right to file a complaint in accordance with Article 7a of the Consumer Rights Act , regardless of whether the problem is due to AI or other factors.
13.3 The Seller agrees to ensure that any AI-generated content that is made available to the Customer is clearly marked as created or supported by artificial intelligence, in accordance with the transparency requirements of the AI Act.

13.4 The Seller guarantees that the content generated by AI complies with applicable laws, including copyright, consumer law and ethics. The Service Provider shall be liable for any content generated by AI that is misleading, untrue or violates the rights of consumers, including unfair market practices in accordance with the Law on Consumer Rights.

13.5 Detailed Provisions for Services Using AI:

By ordering the service, the customer consents to the processing of his voice and image (biometric) data for the purpose of creating the AI voice-over model and lip-synchronization, in accordance with the Privacy Policy.
The vendor guarantees that the animations and images generated by the AI will comply with the provided guidelines and will not contain misleading content. Any non-compliance with the contract will be grounds for complaint in accordance with the Law on Consumer Rights.
By ordering the service, the Customer expressly consents to the recording of LLM model training material (30 min) and to the processing of his/her voice and image (biometric) data for the purpose of creating a digital persona and generating video, in accordance with the Privacy Policy.
In case the Vendor provides the Customer with legally required information on a durable medium (e.g. confirmation of the conclusion of a contract, terms of service), and this information is included in an AI-generated video or other AI communication, the Service Provider shall ensure that the content is also provided in a downloadable and durable format (e.g., PDF, email with attachment).
13.6 Customer Rights in Interactions with AI:

has the right to obtain human intervention when interacting with the AI system, especially if it leads to significant decisions or has a significant impact on the Customer;
has the right to challenge a decision made by the AI system;
the right to file a complaint, regardless of whether the problem is due to AI or other factors.
13.7 AI-Generated Content Requirements:

Labeling of AI-Generated Content: Any content (text, images, video) generated or supported by AI will be clearly labeled so that the Customer is aware of its origin.
Liability for Misleading Content: The Store is liable for any AI-generated content that is misleading, untrue, or violates the rights of consumers, including unfair market practices under the Consumer Rights Act and the Competition and Consumer Protection Act.
Ensuring Legal Compliance: The Store agrees to ensure that the content generated by AI complies with applicable laws, including copyright and consumer laws.
13.8 Specific Provisions for AI Use Cases:

Sending a reminder to give feedback by email through a plug-in installed in WordPress:
The Store may use automated tools, including AI systems, to manage after-sales communications, including sending reminders to give feedback on purchased products.
The customer has the option to opt-out of receiving such reminders at any time, through the opt-out link provided in each email message.
AI video production
Videos showcasing products or services available on the Store may be generated using AI technology.
The Store guarantees that AI-generated video content is accurate and consistent with the actual state of the product/service.
13.9 The following AI practices are prohibited:

marketing, putting into use or using an AI system that uses subliminal techniques that are beyond the person's awareness or deliberate manipulative or misleading techniques, the purpose or effect of which is to make a significant change in the behavior of an individual or a group of individuals by significantly impairing their ability to make informed decisions, thereby causing them to make a decision that they would not otherwise make, in a manner that causes or is likely to cause them, another person or a group of individuals serious harm;
marketing, putting into use, or using an AI system that takes advantage of the vulnerabilities of an individual or a specific group of individuals due to their age, disability, or particular social or economic situation, the purpose or effect of which is to make a significant change in the behavior of a person or a person belonging to that group in a way that causes or is reasonably likely to cause serious harm to that person or another person;
The marketing, commissioning or use of AI systems for the purpose of evaluating or classifying individuals or groups of individuals conducted over a specified period of time on the basis of their social behavior or known, inferred or predicted personal characteristics or personality traits, when the social scoring leads to one or both of the following effects:
harming or disadvantaging certain individuals or groups of individuals in social contexts that are unrelated to the contexts in which the data were originally generated or collected;
harming or disadvantaging certain individuals or groups of individuals that is unjustified or disproportionate to their social behavior or its severity;
marketing, commissioning for that specific purpose, or using an AI system to conduct risk assessments on individuals to assess or predict the risk of an individual committing a crime, based solely on profiling of the individual or assessing the individual's personality traits and characteristics; This prohibition does not apply to AI systems used to support a human assessment of a person's involvement in criminal activity, which is already based on objective and verifiable facts directly related to the criminal activity;
marketing, commissioning for this specific purpose, or using AI systems that create or expand facial recognition databases through untargeted scraping. untargeted scraping) of facial images from the Internet or closed-circuit television footage;
marketing, putting into use for that specific purpose, or using AI systems to make inferences about an individual's emotions in the workplace or educational institutions, except in cases where the AI system is to be implemented or marketed for medical or security reasons;
13.10. marketing, commissioning for that specific purpose, or using biometric categorization systems that individually categorize individuals based on their biometric data to deduce or infer information about their race, political views, trade union membership, religious or philosophical beliefs, sexuality or sexual orientation; this prohibition does not extend to the labeling or filtering of lawfully acquired biometric datasets, such as images, based on biometric data, or the categorization of biometric data in the area of law enforcement.

14. ILLEGAL CONTENT AND OTHER CONTENT THAT DOES NOT COMPLY WITH THE REGULATIONS

14.1 This section of the Terms and Conditions contains provisions under the Digital Services Act as it relates to the Online Store and the Service Provider. As a rule, the Service Recipient is not obliged to provide content when using the Online Store, unless the Terms and Conditions require specific data (e.g. data for placing an Order). The Service Recipient may be able to add opinions or comments in the Online Store using tools provided by the Service Provider for this purpose. In any case of providing content by the Service Recipient is obliged to comply with the rules contained in the Regulations.

14.2 CONTACT POINT - The Service Provider designates the email addressstudio@nullvideospace.agencyas a single point of contact. The point of contact shall enable the Service Provider to communicate directly with the authorities of the Member States, the European Commission and the Digital Services Board, and at the same time shall enable the recipients of the service (including the Service Recipients) to communicate directly, quickly and in a friendly manner with the Service Provider electronically, for the purpose of applying the Digital Services Act. The Service Provider shall indicate the Polish language and the English language for communication with its point of contact.

14.3 Procedure for reporting Illegal Content and acting in accordance with Article 16 of the Digital Services Act:

At the e-mail addressstudio@nullvideospace.agency, any person or any entity may report to the Service Provider the presence of certain information that the person or entity considers to be Illegal Content.
The report should be sufficiently precise and adequately justified. To this end, Service Provider shall allow and facilitate submissions to the email address provided above that contain all of the following: (1) a sufficiently substantiated explanation of the reasons why the person or entity alleges that the reported information constitutes Illegal Content; (2) a clear indication of the exact electronic location of the information, such as the exact URL(s), and, where applicable, additional information to identify the Illegal Content, as appropriate to the type of content and the specific type of service; (3) the name and email address of the person or entity making the report, except for a report concerning information deemed to be related to one of the offenses referred to in Art. 3-7 of Directive 2011/93/EU; and (4) a statement confirming the bona fide belief of the person or entity making the notification that the information and allegations contained therein are correct and complete.
The notification referred to above shall be deemed to give rise to actual knowledge or knowledge for the purposes of Art. 6 of the Digital Services Act with respect to the information to which it relates, if it enables the Service Provider acting with due diligence to determine, without detailed legal analysis, the illegal nature of the activity or information in question.
If the notification contains electronic contact information of the person or entity that made the notification, the Service Provider shall, without undue delay, send such person or entity an acknowledgement of receipt of the notification. The Service Provider shall also notify such person or such entity without undue delay of its decision with respect to the information to which the notification relates, providing information on how to appeal the decision.
The Service Provider shall consider all notifications it receives under the mechanism referred to above and make decisions with respect to the information to which the notification relates in a timely, non-arbitrary and objective manner and with due diligence. If the Service Provider uses automated means for the purpose of such consideration or decision-making, it shall include information on this subject in the notification referred to in the preceding paragraph.
14.4 Information on restrictions that the Service Provider imposes in connection with the use of the Online Store, with respect to information provided by Service Recipients:

The following rules apply to the provision of any content within the Internet Shop:
the obligation to use the Internet Shop, including to post content (e.g. opinions or comments), in accordance with its purpose, with these Terms and Conditions and in a manner consistent with the law and morality, with due regard to respect for personal rights and copyrights and intellectual property rights of the Service Provider and third parties;
the obligation to enter content that is consistent with the facts and in a manner that is not misleading;
prohibition to provide content of an unlawful nature, including the prohibition to provide Illegal Content;
prohibition to send unsolicited commercial information (spam) via the Online Store;
prohibition to provide content that violates generally accepted principles of netiquette, including content that is vulgar or offensive;
the obligation to have - if necessary - all required rights and permissions to provide such content on the pages of the Online Store, in particular copyright or required licenses, permissions and consents for their use, distribution, sharing, or publication, especially the right to publish and distribute in the Online Store and the right to use and distribute the image or personal data in the case of content that includes the image or personal data of third parties;
the obligation to use the Online Store in a manner that does not pose a security risk to the Service Provider's IT system, the Online Store or third parties.
The Service Provider reserves the right to moderate the content provided by Service Recipients to the Web Shop. Moderation shall be carried out in good faith and with due diligence and on the Service Provider's own initiative or upon notification received in order to detect, identify and remove Illegal Content or other content that does not comply with the Terms and Conditions, or to prevent access to it or to take the necessary measures to comply with the requirements of European Union law and national law compatible with European Union law, including the requirements set forth in the Digital Services Act, or the requirements contained in the Terms and Conditions.
The moderation process may be carried out manually by a human being or may rely on automated or semi-automated tools to help the Service Provider identify Illegal Content or other content that does not comply with the Terms of Service. Once such content has been identified, the Service Provider shall make a decision as to whether to remove or disable access to the content or otherwise limit its visibility or take such other action as it deems necessary (e.g., contacting the Client to clarify objections and amend the content). The Service Provider shall clearly and easily understandably inform the Client who provided the content (if it has his contact information) of its decision, the reasons for its decision and the available options for appealing the decision.
In exercising its rights and obligations under the Digital Services Act, the Service Provider shall act with due diligence, in an objective and proportionate manner, and with due regard to the rights and legitimate interests of all parties involved, including the recipients of the service, in particular taking into account the rights enshrined in the Charter of Fundamental Rights of the European Union, such as freedom of expression, freedom and pluralism of the media and other fundamental rights and freedoms.
14.5 Any comments, complaints, complaints, appeals or objections regarding decisions or other actions or lack of action taken by the Service Provider on the basis of a notification received or a decision of the Service Provider taken in accordance with the provisions of these Regulations may be submitted in a procedure analogous to the complaint procedure indicated in Section 7 of the Regulations. The use of this procedure is free of charge and allows the submission of complaints electronically to the e-mail address provided. The use of the procedure for filing and processing complaints is without prejudice to the right of the person or entity in question to initiate proceedings before a court of law and does not affect his other rights.

14.6 The Service Provider shall consider all comments, complaints, complaints, appeals or objections regarding decisions or other actions or inaction taken by the Service Provider on the basis of a notification received or decision made in a timely, non-discriminatory, objective and non-arbitrary manner. If the complaint or other notification contains sufficient reasons for the Service Provider to believe that its decision not to act on the notification is unjustified or that the information complained of is not illegal and in violation of the Regulations, or contains information indicating that the complainant's action does not justify the measure taken, the Service Provider shall, without undue delay, rescind or modify its decision as to whether to remove or prevent access to the content or otherwise limit its visibility, or take such other action as it deems necessary.

14.7 Service Recipients, persons or entities that have reported Illegal Content to whom Service Provider's decisions regarding Illegal Content or content that does not comply with the Terms of Service are directed, shall have the right to choose any out-of-court dispute resolution body certified by the Digital Services Coordinator of the Member State to resolve disputes regarding such decisions, including with respect to complaints that have not been resolved through Service Provider's internal complaint handling system.

15. FINAL PROVISIONS

15.1 Contracts concluded through the Online Store are concluded in the Polish language.

15.2 Amendment of the Regulations:

The Service Provider reserves the right to amend these Terms and Conditions for important reasons, that is: changes in the law; changes in the methods or dates of payment or delivery, being subject to legal or regulatory obligations; changes in the scope or form of the Electronic Services provided; addition of new Electronic Services; the need to counteract unforeseen and imminent threats related to the protection of the Online Store, including Electronic Services and Service Recipients/Customers from fraud, malware, spam, data breaches or other cyber security threats - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions.
Notice of proposed changes shall be sent at least 15 days in advance of the effective date of such changes, subject to change may be made without observance of the 15-day notice period in the event that the Service Provider: (1) is subject to a legal or regulatory obligation under which it is required to amend its Terms and Conditions in a manner that prevents it from complying with the 15-day notice period; or (2) needs to amend its Terms and Conditions on an exceptional basis to address an unforeseen and imminent threat related to the protection of the Online Store, including the Electronic Services and Service Recipients/Customers from fraud, malware, spam, data breaches or other cyber security threats. In the last two cases referred to in the preceding sentence, the implementation of changes shall be effective immediately, unless a longer implementation period is possible or necessary, which shall be notified by the Service Provider in each case.
In the case of continuous contracts, the Customer has the right to terminate the contract with the Service Provider before the expiration of the notification period for the proposed changes. Such termination shall become effective within 15 days of receipt of the notification. In the case of a continuous contract, the amended Terms and Conditions shall be binding on the Service Recipient if the Service Recipient has been properly notified of the changes in accordance with the notification period prior to their implementation and has not terminated the contract during this period. In addition, at any time after receiving notification of the changes, the Service Recipient may accept the changes being made and thus waive the continuation of the notification period. In the case of conclusion of a contract of a different nature than continuous contracts, the changes to the Terms and Conditions will not in any way affect the rights acquired by the Customer before the effective date of the changes to the Terms and Conditions, in particular, the changes to the Terms and Conditions will not affect the Orders already placed or placed and the Sales Agreements concluded, executed or performed.
In the event that the change to the Terms and Conditions would result in the introduction of any new fees or an increase in current fees, the consumer has the right to withdraw from the contract.
15.3 In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: Civil Code; the Act on Provision of Electronic Services of July 18, 2002 (Journal of Laws 2002 No. 144, item 1204, as amended); the Act on Consumer Rights; and other relevant provisions of commonly applicable law.
